Provider and agreement

NOVA POP! is provided by Cod3.io GmbH, Hegiweg 2, 4457 Diegten, Switzerland. By downloading, accessing, or using NOVA POP!, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the game.

These Terms supplement Apple’s Standard Licensed Application End User License Agreement (Standard EULA) and applicable App Store rules. They do not replace mandatory platform or consumer terms. If a provision conflicts with mandatory law, the mandatory rule prevails and the remaining provisions continue to apply.

Eligibility and guardians

You must be legally able to accept these Terms. If you are below the age at which you may enter this agreement or make purchases in your country, a parent or legal guardian must review and accept the Terms and supervise your use.

Guardians are responsible for device, Family Sharing, Ask to Buy, Screen Time, purchase, and advertising-consent settings available through Apple and the app.

Licence and permitted use

Subject to these Terms, Cod3.io GmbH grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to use NOVA POP! on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules. Family Sharing or volume purchasing may apply where Apple permits it.

NOVA POP! and its software, characters, artwork, music, sounds, names, logos, game systems, text, and other content are owned by Cod3.io GmbH or its licensors. No rights are granted except those expressly stated here.

The game and live services

NOVA POP! is a physics-merge puzzle with collection, challenges, leaderboards, live events, advertising, replays, and optional purchases. Features can vary by device, operating-system version, language, region, purchase status, test cohort, and release stage.

We may balance scores, rewards, drop rates, perks, challenges, seasons, event schedules, or other mechanics to keep the game fair, secure, and enjoyable. We may also add, change, suspend, or discontinue features for product, legal, security, technical, or operational reasons. Where required, we will provide reasonable notice or a remedy for material changes to paid ongoing benefits.

Daily challenge seeds, timers, rankings, and event availability may be reset or corrected if affected by an error, exploit, outage, or unfair play. We do not guarantee that every feature or online service will always be available or error-free.

Purchases and subscriptions

NOVA POP! may offer consumable currency, permanent entitlements such as ad removal, passes, bundles, and automatically renewing subscriptions. The App Store purchase sheet shows the product, local price, currency, billing period, trial (if any), and final charge before you confirm.

Apple charges your Apple account and manages payment credentials. An automatically renewing subscription continues for the period and price shown by Apple until cancelled through your Apple subscription settings. Cancellation normally takes effect at the end of the paid period. Deleting the app does not cancel a subscription.

Restores, renewals, expiry, revocation, and refunds are applied from verified StoreKit transactions. Refund eligibility and statutory withdrawal rights are determined by Apple’s processes and mandatory consumer law. Contact Apple to request a refund for an App Store purchase.

Virtual currency and digital items

Virtual currencies, boosts, capsules, cosmetics, passes, perks, and other digital items are licensed for personal entertainment within NOVA POP! They are not legal tender, have no cash value, do not earn interest, and may not be sold, transferred, or exchanged outside mechanisms expressly provided by the game.

We may adjust the availability, name, presentation, or balancing of virtual items. We will not arbitrarily remove a paid permanent entitlement, and any mandatory remedies remain available. If the service ends, unused virtual items may cease to be available subject to applicable law and any notice we are required to provide.

Advertising and rewarded placements

The free experience may include interstitial and rewarded ads. A rewarded ad grants the reward only after the advertising provider reports successful completion. Network errors, abandoned views, or invalid traffic may prevent a reward from being granted.

Where offered, an ad-removal purchase removes the placements described in its purchase screen; it may not remove optional rewarded placements or cross-promotion clearly excluded from that product. Advertising privacy choices are described in the Privacy Policy and can be reopened in the app where required.

Fair play and prohibited conduct

You may not cheat, automate play, exploit bugs, manipulate clocks or scores, falsify purchases, interfere with advertising rewards, modify the app, bypass security or payment controls, introduce malicious code, scrape services, harass others, or use NOVA POP! unlawfully.

You may not reverse engineer, decompile, disassemble, or derive source code except to the limited extent expressly permitted by mandatory law. Please report serious exploits responsibly rather than using or distributing them.

We may invalidate affected scores or rewards and restrict online features where reasonably necessary to protect players or the service. Where appropriate, we will consider context and provide an opportunity to contact support.

Replays and sharing

You may export short clips of your own gameplay through ReplayKit. You are responsible for the destination you select, your caption or additions, and ensuring that sharing complies with law and the destination platform’s rules. Do not include unlawful, infringing, abusive, or private third-party material.

You keep any rights you may have in your original additions. Cod3.io GmbH retains all rights in NOVA POP! footage, characters, audio, and branding. We allow non-commercial sharing of ordinary gameplay clips and streams, subject to these Terms and any separate fan-content guidance we publish.

Apple platform terms

This agreement is between you and Cod3.io GmbH, not Apple. Cod3.io GmbH, not Apple, is responsible for NOVA POP!, its maintenance and support, and addressing product, legal, privacy, consumer-protection, and intellectual-property claims to the extent required by applicable App Store terms.

Apple has no obligation to provide maintenance or support for NOVA POP!. Apple and its subsidiaries are third-party beneficiaries of the applicable provisions and may enforce them. You must comply with third-party terms and applicable export-control and sanctions laws.

Privacy

The Privacy Policy explains local storage, iCloud, Game Center, StoreKit, AdMob, notifications, ReplayKit, website logs, retention, and your choices. It forms part of these Terms.

Availability, warranty, and liability

We use reasonable care to provide NOVA POP!, but games, devices, networks, stores, and third-party services can fail or be unavailable. To the maximum extent permitted by law, NOVA POP! is provided as available and without guarantees of uninterrupted operation, permanent preservation of local data, a particular ranking, or continued availability of a specific free feature.

To the maximum extent permitted by law, Cod3.io GmbH is not liable for indirect or consequential loss, lost progress caused by device failure or missing backups, third-party platforms, or use contrary to these Terms. Nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life or health, mandatory product liability, fraud, or consumer rights that cannot legally be excluded or limited.

Termination

You may stop using NOVA POP! and delete the app at any time. You must separately cancel any active subscription through Apple. Local deletion does not necessarily remove iCloud, Game Center, App Store, or advertising-provider records controlled through those services.

Your licence ends if you materially breach these Terms. We may restrict affected online functions for serious or repeated violations, fraud, security threats, legal requirements, or service discontinuation. Provisions that by their nature should survive—including ownership, accrued payment obligations, disclaimers, and liability rules—remain in effect.

Changes, governing law, and contact

We may update these Terms for legal, security, operational, platform, or product reasons. Material changes will be communicated appropriately and, where required, take effect only after notice or consent. The date and version at the top identify the current Terms.

Swiss law applies, excluding conflict-of-law rules, without depriving consumers of mandatory protections available at their habitual residence. The courts at the registered seat of Cod3.io GmbH have jurisdiction where legally permitted; mandatory consumer venues remain unaffected.
